Welcome to Love & Always. These Terms of Service ("Terms") govern your access to and use of the website located at www.loveandalways.com (the "Site") and the purchase of any products from Customzone LLC, doing business as Love & Always ("Love & Always," "we," "us," or "our"). By visiting the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase from the Site. By placing an order you represent that you meet this requirement and that all information you provide is accurate and complete.
2. Our Products
We sell made-to-order, personalized canvas art, including watercolor portraits created from photographs you supply, along with names, dates, and messages you provide. Because every piece is created specifically for you, products are produced only after an order is placed and, where applicable, after you approve a digital proof. Product images on the Site are mockups for illustration; the finished piece will be based on your own photo and personalization details. Colors may vary slightly between screens and printed canvas.
3. Personalization & Your Content
When you upload a photograph or enter text for personalization ("Your Content"), you represent and warrant that: (a) you own Your Content or have obtained all rights and permissions necessary to use it, including the consent of any identifiable individuals; (b) Your Content does not infringe any copyright, trademark, privacy, publicity, or other right of any third party; and (c) Your Content is not unlawful, obscene, hateful, or otherwise objectionable. You grant us a non-exclusive, royalty-free license to use, reproduce, modify, and adapt Your Content solely for the purpose of designing, proofing, producing, and delivering your order and handling any related support. We do not use customer photos for marketing without your express permission. We reserve the right to refuse or cancel any order whose content we deem inappropriate, in our sole discretion, with a full refund.
You are responsible for the accuracy of names, dates, spelling, and other details you enter. Please review your digital proof carefully; once you approve a proof, the piece is printed exactly as approved.
4. Orders, Pricing & Payment
All prices are listed in U.S. dollars and exclude applicable taxes and shipping unless stated otherwise. We reserve the right to change prices at any time, but changes will not affect orders already placed. Placing an order constitutes an offer to purchase; we may accept or decline any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel an order, we will refund any amount paid. Payment is processed securely by Shopify Payments and our third-party payment providers; we do not store full payment card details.
5. Proofs, Production & Cancellation
For portrait products we email a digital proof, normally within 2–3 business days of receiving your photo and details. Production begins after you approve the proof and normally takes 3–5 business days. You may cancel for a full refund within 24 hours of placing your order, or at any time before you approve your proof. Once a proof is approved and production has started, orders cannot be cancelled or changed because the item is custom-made for you.
6. Shipping & Delivery
Shipping terms, timelines, and rates are described in our Shipping Policy. Delivery estimates are provided in good faith but are not guaranteed. Risk of loss passes to you when the carrier marks the package as delivered to the address you provided. Please ensure your shipping address is correct; we are not responsible for orders shipped to an incorrect address supplied by you.
7. Returns, Replacements & Refunds
Because each product is personalized, we do not accept returns for change of mind. If your order arrives damaged, defective, or differs materially from your approved proof, we will replace it free of charge or refund you in full, as described in our Refund Policy. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
8. Intellectual Property
The Site and all content on it, including artwork styles, layouts, text, graphics, logos, and software, are owned by or licensed to Love & Always and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission. Finished artwork we create from Your Content is licensed to you for personal, non-commercial use. We retain ownership of our underlying artistic templates, styles, and designs.
9. Acceptable Use
You agree not to use the Site for any unlawful purpose; to interfere with or disrupt the Site or its servers; to attempt to gain unauthorized access to any part of the Site; to scrape or harvest data; or to upload malicious code. We may suspend or terminate your access for violating these Terms.
10. Reviews & Submissions
If you submit reviews, comments, photos of your finished canvas, or other material (other than order personalization), you grant us a perpetual, worldwide, royalty-free license to use, publish, and display that material in connection with our business, and you represent that it is truthful and does not violate any third-party rights. We may remove any submission at our discretion.
11. Third-Party Links & Services
The Site may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is at your own risk.
12. Disclaimer of Warranties
THE SITE AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR OUR REFUND POLICY.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LOVE & ALWAYS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Love & Always from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your violation of any rights of a third party.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us at support@loveandalways.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction, except that either party may bring an individual claim in small-claims court.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy, Shipping, and Refund Policies, constitute the entire agreement between you and Love & Always regarding the Site and your purchases.
